it actually isI'm not entirely sure if that disallowed Namco from using the original title though.
You could also make the argument that they wanted to establish the series here under the Tales of Destiny moniker. There is evidence, too: if you look at Tales of Phantasia's entry, you'll see that it had a
prior registration number. That registration number is the same as Tales of Destiny's. This leads me to believe Namco USA was definitely considering a US ToP PSX release and would market it as a sequel to Destiny, but then skipped it in favor of Eternia (latest and greatest and all that).
After those "failures", they brought over Symphonia and abandoned the Destiny name to give the series a fresh start. Unfortunately, that game's runaway success seems to have created a side-effect of a belief that US gamers only want 3D games on consoles. And yet, none of the 3D games that followed had any better sales than the original US PSX releases. I hear that radiant mythology bombed harder than anything else before it...
That certainly helped cleared it up. Like I said, I thought the term Eternia was something that was not legally exclusive to He-Man, hence why I always did not take the He-Man argument with a serious mind. It really helped. Even then, I still did not think that was the case with the renaming anyway.
I actually did hear about that second bit. I remember reading an interview on IGN regarding the release of Tales of Eternia in North America. If I remember correctly, it was said they were considering localizing Tales of Phantasia PS1 but then heard about Tales of Eternia and went with that instead. While I'm at it, I also remember hearing that the name change was also done to show the relation to the series.
Yeah, I haven't done any of my own digging in the US Patent and Trademark Office since I didn't browse around enough there.
Oh yeah, Kaji. That He-Man/Tales of Eternia spoof sig is still priceless.
